1. About VDBL Group

VDBL Group is a remote HR and Labour advisory practice operating across South Africa. VDBL Group provides business, HR and labour advisory services to South African SMEs and individuals.

VDBL Group is the responsible party as defined under the Protection of Personal Information Act 4 of 2013 (POPIA). VDBL Group determines the purpose and means of processing personal information collected through this website.

2. What personal information VDBL Group collects

VDBL Group collects the following categories of personal information through the website enquiry form:

• Name
• Business name
• Contact number
• Matter type (selected from a dropdown — the nature of the enquiry)

If a visitor contacts VDBL Group directly by email following an enquiry, any personal information included in that correspondence is also collected and processed for the purpose of responding to and handling the enquiry.

For individuals using VDBL Group's CV or career advisory services, additional information may be collected during the advisory process, including employment history, qualifications and career objectives. This information is provided voluntarily by the individual and is used solely for the purpose of providing the agreed service.

VDBL Group does not collect sensitive personal information as defined under POPIA s26 through its website, including information about health, race, ethnicity, religion, sexual orientation, or criminal history.

3. How VDBL Group collects information

• Through direct email correspondence to info@vdblgroup.com.
• Through telephone or video call communications initiated following an enquiry.

VDBL Group does not purchase, source or receive personal information from third-party data brokers or marketing lists.

4. Why VDBL Group collects this information

• To respond to enquiries submitted through the website.
• To contact the data subject to discuss the matter raised in the enquiry and the appropriate way forward.
• To provide the HR, labour or advisory services requested.
• To communicate with clients in the course of an active advisory engagement.
• To comply with applicable legal and regulatory obligations.

VDBL Group does not process personal information for marketing purposes and does not send unsolicited commercial communications.

5. Lawful basis for processing

• Consent: where a data subject submits an enquiry through the website form, the act of submission and the accompanying disclosure constitute consent to the collection and processing of that information for the purpose of responding to the enquiry.
• Legitimate interest: VDBL Group has a legitimate interest in receiving and responding to business enquiries submitted voluntarily by prospective clients.
• Contractual necessity: where a service agreement exists between VDBL Group and a client, personal information is processed as necessary to perform the services agreed upon.
• Legal obligation: where processing is required to comply with applicable South African legislation.

6. Sharing of personal information

VDBL Group does not sell, rent or trade personal information to any third party. VDBL Group does not share personal information with third parties for marketing or commercial purposes.

VDBL Group may share personal information in the following limited circumstances only:

• Where required by South African law, a court order, or a competent authority with lawful authority to require disclosure.
• Where the data subject has given explicit consent to share their information with a specific third party for a specific purpose.

Where VDBL Group uses third-party service providers to deliver services (for example, email or communication platforms), those providers process information only on behalf of VDBL Group and are bound by confidentiality obligations.

7. How long VDBL Group retains information

• Enquiry information where no engagement followed: retained for a maximum of 12 months from the date of the enquiry, after which it is securely deleted.
• Information relating to an active or completed advisory engagement: retained for a period of 5 years from the conclusion of the engagement.
• Information processed for CV or career advisory purposes: retained for a maximum of 24 months from the date of the last service interaction, unless the individual requests earlier deletion.

8. Security of personal information

VDBL Group takes reasonable and appropriate technical and organisational measures to protect personal information against loss, unauthorised access, disclosure, alteration or destruction. All communications with VDBL Group by email are handled through secured accounts.

While VDBL Group takes these precautions, no method of electronic transmission or storage is completely secure. In the event of a security compromise that affects the rights of data subjects, VDBL Group will comply with the notification obligations under POPIA s22.

9. Your rights as a data subject

• Right to access: You have the right to request confirmation of whether VDBL Group holds personal information about you, and to request a copy of that information.
• Right to correction: You have the right to request that inaccurate, misleading or incomplete personal information held by VDBL Group be corrected.
• Right to deletion: You have the right to request that VDBL Group delete your personal information where it is no longer necessary for the purpose for which it was collected, or where you withdraw consent and no other lawful ground for processing applies.
• Right to object: You have the right to object to the processing of your personal information on grounds relating to your particular situation, where that processing is based on legitimate interest.
• Right to withdraw consent: Where processing is based on your consent, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing that took place before withdrawal.
